1. Acceptance of Terms

Welcome to LucAId. These Terms of Service ("Terms") constitute a legally binding agreement between you and LucAId ("we," "us," or "our") governing your use of the LucAId mobile application (iOS and Android) and website at lucaid.app (collectively, the "Service").

By creating an account, downloading the app, or using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

2. Description of Service

LucAId is an AI-powered dream journaling application designed to help users record, explore, and understand their dreams. Our Service provides:

• Dream journal functionality for text and audio entries
• AI-powered dream analysis and pattern recognition
• Tools and techniques for lucid dreaming practice
• Dream statistics and insights
• Personalized recommendations based on your dream patterns

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. Eligibility

To use our Service, you must:

• Be at least 13 years of age (or 16 in certain jurisdictions)
• Have the legal capacity to enter into a binding agreement
• Not be barred from using the Service under applicable law

If you are under 18 (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

You may only have one account. We reserve the right to suspend or terminate accounts that violate these Terms or appear to be duplicates.

5. User Content

Ownership

You retain full ownership of all content you create and submit through the Service, including your dream journal entries, audio recordings, notes, and any other materials ("User Content"). Your dreams are personal, and we do not claim ownership over them.

License to LucAId

By submitting User Content, you grant LucAId a limited, non-exclusive, worldwide, royalty-free license to store, process, display (to you), and analyze your User Content solely for the purpose of providing and improving the Service. This license includes:

• Storing your dream journal entries securely
• Displaying your content back to you within the app
• Processing your entries to provide AI-powered analysis and insights
• Creating anonymized, aggregated statistics (with no personally identifiable information)

This license terminates when you delete your content or account, except for anonymized data that cannot be traced back to you.

Your Responsibilities

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not infringe any third party's rights
• Your User Content complies with these Terms and applicable law

6. Acceptable Use Policy

You agree NOT to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Interfere with or disrupt the Service or servers
• Use automated means (bots, scrapers, etc.) to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Circumvent any security measures or access restrictions
• Use the Service for any commercial purpose without our written consent
• Transmit viruses, malware, or other harmful code

We reserve the right to investigate violations and take appropriate action, including removing content, suspending or terminating accounts, and reporting illegal activity to authorities.

7. Intellectual Property

Our Property

The Service, including all software, code, design, graphics, text, logos, trademarks, and other content (excluding User Content), is owned by LucAId or our licensors and is protected by intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. This license does not include:

• Modifying or copying our materials
• Using our materials for commercial purposes
• Attempting to reverse engineer any software
• Removing any copyright or proprietary notices
• Transferring materials to another person or "mirroring" materials on any other server

Trademarks

"LucAId" and our logo are trademarks of LucAId. You may not use these marks without our prior written permission.

Feedback

If you provide us with feedback, suggestions, or ideas, you grant us the right to use such feedback without restriction or compensation to you.

8. Subscriptions and Payments

Subscription Plans

LucAId offers free and premium subscription tiers. Premium features require a paid subscription. Pricing and features for each tier are displayed in the app and on our website.

Billing and Auto-Renewal

SUBSCRIPTIONS AUTOMATICALLY RENEW UNLESS CANCELED. By subscribing, you authorize us (via the applicable app store or payment processor) to charge your payment method on a recurring basis until you cancel.

• Subscriptions renew at the end of each billing period (monthly or annually)
• You will be charged within 24 hours before the end of the current period
• Prices may change; we will notify you in advance of any price increases

Payment Processing

Payments are processed through Apple App Store, Google Play, or Stripe. We do not store your full payment card details. Payment is subject to the terms of your payment provider.

Free Trials

If we offer a free trial, you will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. You will be charged after the trial unless you cancel.

Cancellation

You may cancel your subscription at any time:

• iOS: Through your Apple ID account settings
• Android: Through Google Play Store subscription settings
• Web: Through your account settings or by contacting support

Cancellation takes effect at the end of your current billing period. You will retain access to premium features until then.

Refunds

Refund policies are governed by the applicable app store (Apple or Google). Generally:

• Refund requests should be submitted through the respective app store
• We do not guarantee refunds and have limited control over app store refund decisions
• For subscriptions purchased directly through our website, contact us within 14 days of purchase to request a refund

9. Health and Medical Disclaimer

LUCAID IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR MEDICAL CONDITION, INCLUDING SLEEP DISORDERS.

LucAId is a dream journaling and lucid dreaming exploration tool intended for informational, educational, and entertainment purposes only. The Service is not a substitute for professional medical advice, diagnosis, or treatment.

You should:

• Always seek the advice of your physician or qualified health provider with any questions about a medical condition
• Never disregard professional medical advice or delay seeking it because of something you read or experienced in LucAId
• Consult a healthcare professional if you experience sleep problems, nightmares, sleep disorders, or any mental health concerns

Lucid dreaming practices may not be suitable for everyone. If you have a history of mental health conditions, sleep disorders, or other health concerns, please consult with a healthcare professional before using lucid dreaming techniques.

WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR EFFECTIVENESS OF ANY INFORMATION, TECHNIQUES, OR FEATURES PROVIDED THROUGH THE SERVICE FOR ANY HEALTH-RELATED PURPOSES.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Any errors or defects will be corrected
• The Service is free of viruses or harmful components
• The results obtained from using the Service will be accurate or reliable
• Any AI-generated analysis or insights will be accurate or suitable for your needs

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such cases, our liability is limited to the fullest extent permitted by law.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LUCAID, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Any errors, inaccuracies, or omissions in the AI-generated analysis or insights

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the limitation or exclusion of liability for certain types of damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless LucAId and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party right, including intellectual property rights
• Your User Content
• Any claim that your User Content caused damage to a third party

13. Termination

Termination by You

You may terminate your account at any time by deleting your account through the app settings or by contacting us at support@lucaid.app. Upon termination, your right to use the Service ceases immediately.

Termination by Us

We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. We may also terminate accounts that have been inactive for an extended period.

Effect of Termination

Upon termination:

• Your license to use the Service terminates immediately
• We may delete your account and User Content (subject to our data retention policies in the Privacy Policy)
• Any outstanding payment obligations remain due
• Provisions that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution provisions)

14. Governing Law and Disputes

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Informal Resolution

Before initiating any formal dispute proceeding, you agree to first contact us at legal@lucaid.app and attempt to resolve the dispute informally for at least 30 days.

Jurisdiction

If informal resolution is unsuccessful, you agree to submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes arising from these Terms or the Service.

EU/EEA Users

If you are a consumer in the European Union or European Economic Area, nothing in these Terms affects your mandatory statutory rights, and you may bring legal proceedings in the courts of your country of residence.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of these Terms
• Notify you via email and/or in-app notification at least 30 days before changes take effect
• For significant changes affecting your rights, we may require you to accept the updated Terms

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.

16. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LucAId regarding the Service and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us.

Assignment

You may not assign or transfer these Terms or your rights and obligations without our prior written consent. We may assign these Terms without restriction in connection with a merger, acquisition, or sale of assets.

No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

Force Majeure

We are not liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control.
